Is CBD Oil Legal in Texas? State Laws & Regulations

Texas is a state in the South Central Region of the United States. It is the second-largest U.S. state by both area and population.

Texas law defines hemp as – “the plant Cannabis sativa L. and any part of that plant, including the seeds of the plant and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis.”

The legalization of Hemp-derived products is legal in Texas. This happened in 2019, with a bill signed by Gov. Greg Abbott which allowed the legalization of CBD made from hemp in Texas. As the bill helped to set up a much clearer definition of the state’s stance on legalized CBD. One of the important rules that came out of this bill is the requirements of CBD to get approved by the state. A CBD oil must contain less than 0.03% of THC to be counted as legal. Since the THC adds the psychoactive ingredient in the drug, which then helps the person who consumes the CBD to feel High. The bill also allowed hemp growers to start obtaining licenses to grow them legally in the state.

The legality of the CBD

The rules that came with the bill, specified that only 0.03% of the hemp will be considered as the right amount for it to get passed as a legal. What is not legal is marijuana, possession of the just mere two ounces of marijuana in Texas will land you as a class B misdemeanor, 180 days in prison with a $2000 fine. The worst thing about this is that it can get even more damaging. If you compare the criminal behavior of ruling now with what it was back in 1973.

You will be astounded to learn that back in ‘73 if a person possessed CBD at any amount, they would have been thrown into jail for 2 years. But as you can tell the government looked hard into this law, and has made some changes to it, and they brought down criminal behavior from life imprisonment to a misdemeanor.

The rules clearly say that any CBD oil has THC over the 0.03% value that would be considered legal. The state has no way of knowing the accurate number of CBD oil because the state can’t test the content of cannabis plants.

Achieving Accuracy in THC Testing

This is where the argument goes against one from another. Not having the tools to accurately find out the correct THC amount in the CBD, the police have no way of knowing the real value, so they have to rely on the words. But that doesn’t mean you can possess illegal substances, as the state is moving fast onto trying out different methods for the testing of the CBD and other products for the THC element.

Accessibility of CBD

When it comes to the availability of the compound, the answer is yes, you can get CBD from all over Texas. One can easily order them online and it will get delivered straight to the door without any issue. It is the most preferable way of getting CBD for a vast majority of people from all the states in the country. Many CBD companies online offer quality based hemp sourced products. If online isn’t more to your liking, then you can switch to the offline method, since the legalization of CBD has opened the doors to many people to create dispensers and CBD stores.

Here you need to focus on the little thing, which is to get the CBD with the right amount of THC since there are many variations of CBD available in the store. Each of them would have the label attached to the bottle to let the user know about the THC amount on the drug. It has to stay under the 0.3% mark for the drug to be legal. Of course, here you can’t expect the CBD to be 100% pure. Manufacturers always mix up CBD with other variants and with THC, and not all the companies share the same type of manufacturing process.

Marijuana is still considered illegal since it has a higher amount of THC. The purchase of CBD oil is accepted without a doctor’s prescription and is allowed as long as the THC amount stays under the 0.3% ratio.

Guidelines and Cultivation

In short, yes, the citizens of Texas have every right to get CBD. Only if they follow all the procedures and guidelines that have been set up for the drug. But you should always be aware of where you get your CBD product. It is legal to own it but there are other rules that come with the purchase. One of the signs of them is following the right amount of THC. If it goes above, then you have to face the law. Nearly every product you buy online or planning to get them from the local dispensers. As the new rulings have enabled Texas from growing and cultivating industrial hemp and any part that is any way related to the plant.

There will be a review for every product that you will see on the shelf of a store. Make sure to read about it, and all the important aspects of the bottle, to confirm, whether they are right for you or will get you in trouble. Normally the bootle would have ‘Industrial hemp’ or ‘mature hemp’, written on it. These products are good to go, make sure to avoid any product that has ‘CBD oil’ or ‘THC’ written on it.

Houston is the most populous city in Texas and the fourth largest in the U.S., while San Antonio is second-most populous in the state and seventh largest in the U.S. Dallas–Fort Worth and Greater Houston are the fourth and fifth largest metropolitan statistical areas in the country, respectively. Other major cities include Austin, the second-most populous state capital in the U.S., and El Paso. Texas is nicknamed the “Lone Star State” for its former status as an independent republic and as a reminder of the state’s struggle for independence from Mexico. The “Lone Star” can be found on the Texas state flag and on the Texas state seal. The origin of Texas’s name is from the word taysha, which means “friends” in the Caddo language.

Due to its size and geologic features such as the Balcones Fault, Texas contains diverse landscapes common to both the U.S. Southern and the Southwestern regions. Although Texas is popularly associated with the U.S. southwestern deserts, less than ten percent of Texas’s land area is desert. Most of the population centers are in areas of former prairies, grasslands, forests, and the coastline. Traveling from east to west, one can observe terrain that ranges from coastal swamps and piney woods, to rolling plains and rugged hills, and finally the desert and mountains of the Big Bend.

The term “six flags over Texas”,[note 1] refers to several nations that have ruled over the territory. Spain was the first European country to claim and control the area of Texas. France held a short-lived colony. Mexico controlled the territory until 1836 when Texas won its independence, becoming an independent Republic. In 1845, Texas joined the union as the 28th state. The state’s annexation set off a chain of events that led to the Mexican–American War in 1846. A slave state before the American Civil War, Texas declared its secession from the U.S. in early 1861 and officially joined the Confederate States of America on March 2 of the same year. After the Civil War and the restoration of its representation in the federal government, Texas entered a long period of economic stagnation.

  1. I make oil from it mostly, and I feel the effects almost instantly. I have smoked it as well. I also make edibles, these can take about an hour to kick in , and will last for a good 2 to 3 hours. I also live in Canada, where marijuana is fully legal and government regulated, like alchhol.
